The petitioner seeks regular bail in connection with Kotwali P.S.Case No.269 of 2017 registered for offences punishable under Sections 417, 418, 419, 420, 465, 466, 467, 468, 469, 470, 208 and 120(B) of the Indian Penal Code. Allegation against the petitioner and another coaccused persons is of running appointment racket and got a latter issued for appointment in the High Court itself. Submission of the learned counsel for the petitioner is that FIR and the impugned order show that she was arrested from the house of one accused, who is named in the FIR and thereafter she has been made accused in this case and two other cases. Further submission is that there is nothing against the petitioner and she is a lady and is in custody for three months. Further submission is that for the same occurrence three cases have been
Patna High Court Cr.Misc. No.46923 of 2017 (2) dt.17-10-2017 lodged and one of them she is on bail, vide order dated 5.9.2017 passed in Cr. Misc. No.38442 of 2017.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Patna in connection with Kotwali P.S.Case no.269 of 2017.
With following conditions :
(i) One of the bailors of the petitioner shall be local person having sufficient immovable property within the jurisdiction of concerned court.
(ii) The petitioner will not induce any witness or tamper with the evidences.
(iii) The petitioner shall co-operate in disposal of trial and make herself available as and when required by the court concerned and in the event of failure to appear before the court below on two consecutive dates without showing any genuine reasons, her bail bond shall be cancelled.
(iv) In future, if she is found involved in similar type of allegation of forgery for appointment, her bail bond shall be cancelled.
With the aforesaid observation, this application is allowed.
