Petitioner, who is in custody, seeks bail in connection with Mairwa P.S. Case No. 37 of 2018 registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code.

Allegation against petitioner is killing of the nephew of the deceased. There is no eye-witness of the occurrence of murder of the nephew of the informant. Nothing has been recovered from the possession of the petitioner. It has been further submitted that similarly placed co-accused persons have been granted bail by co-ordinate Bench of this court as contained in Annexure- 2 and 2(1) of this petition. Considering the aforesaid fact and circumstances of

Patna High Court Cr.Misc. No.56311 of 2018(4) dt.11-10-2018 2/2 the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Siwan in connection with Mairwa P.S. Case No. 37 of 2018.
