JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 366A and 506/34 of the Indian Penal Code.

The accusation is of abducting the minor daughter of the informant.

It is submitted by the learned counsel for the petitioner that the victim in 164 Cr.P.C. statement got her age recorded as 15 years when the court assessed her age as about 18 years whereas the Medical Board assessed the age of the victim as 14-17 years. In 164 Cr.P.C. statement the victim stated that she was called by the wives of Tunna Sharma,Munna Sharma, Sattan Sharma and

Patna High Court Cr.Misc. No.49592 of 2015 (2) dt.05-11-2015 2/2 Shatrughan Sharma when Mohit took her to Ludhiana. It is further submitted that the informant retracted from the initial version and has filed a petition to that effect before the learned court below. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the fact that thrust of accusation is against Mohit and that petitioner is a lady, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Bagaha in connection with Bagaha Mahila P.S. Case No. 30 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
