The petitioner apprehends his arrest in a case under Section 304/34 of the Indian Penal Code.
The petitioner is a registered medical practicener. The allegation is that the petitioner was treating the wife of informant but she could not recover.
It is submitted that the petitioner did not give any wrong medicine not the informant took his wife to any other place for treatment. Nowhere it has come that on account of giving wrong medicine the wife of informant died. The petitioner did not commit any negligence.
Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named
Patna High Court Cr.Misc. No.50957 of 2015 (3) dt.08-12-2015 2/2 petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in Nawada Town (Kadigranj) P.S. Case No. 339 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
