JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Khagaria Muffassil P.S. Case No. 796 of 2015 registered under Sections 147, 148, 149, 341, 323, 307, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that seven persons named in the F.I.R. including the petitioner along with 5 to 6 unknown came from Maize field and started to abuse to the informant and on instruction of petitioner Sukra Yadav fired through rifle causing injury at thigh of informant.

Learned counsel for the petitioner submits that specific allegation is against Sukra Yadav to cause firearm injury at the

The petitioner has falsely been implicated in this case being the father of Sukra Yadav and some other accused with false allegation of order giver. Further submission is that petitioner is aged about 70 years and has no criminal antecedent. Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Khagaria Muffassil P.S. Case No. 796 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
