JUSTICE HARISH KUMAR ORAL ORDER 14-09-2023 Mr. Sanjay Kumar Verma, learned counsel for the petitioner presses the present application for restoration of the writ application bearing CWJC No. 10679 of 2022 to its original file, as the same stood dismissed for default, on account of non compliance of the peremptory order dated 15.11.2022 passed by the learned co-ordinate Bench of this Court.

2. It is submitted that so far other defects are

Patna High Court MJC No.1766 of 2023(2) dt.14-09-2023 2/2 concerned, the same had already removed within the stipulated time, however, only because of the fact that the certified copy of the impugned order could not be filed, the writ petition stood dismissed. Though, subsequently the petitioner obtained the certified copy and the same has been brought on record in the present application also.

3. In view of the submissions made on behalf of the petitioner, the present restoration application stands allowed.

4. Let CWJC No. 10679 of 2022 restored to its original file.

5. As the petitioner has already filed the required certified copy of the District Teachers Employment Appellate Tribunal, Patna dated 05.06.2015, the defect pointed out by the Registry with regard to filing of the certified copy be stands complied.
