The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 384, 325, 427, 504 & 506/34 of the Indian Penal Code.
The petitioner in association of other co-accused is said to have assaulted the brother of the informant due to which he sustained injury on his left shoulder.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case due to dirty village politics. No independent witnesses have supported the prosecution case. The allegation levelled against the petitioner is not specific
Patna High Court CR. MISC. No.42332 of 2022(3) dt.17-02-2023 2/2 rather general and omnibus in nature. Petitioner has no criminal antecedent.
Learned APP for the State vehemently opposing the bail petition submitted that the injury attributed by the petitioner is grievous in nature, hence the petitioner does not deserve bail.
Considering the facts and circumstances of case and particularly considering the criminal antecedents, I am not inclined to enlarge the petitioner on anticipatory bail. The prayer for anticipatory bail of the petitioner is hereby rejected. However, the petitioner is directed to surrender before the learned Court below within six weeks from today and seek regular bail and the learned Court below would pass order on the same day in accordance with law without being prejudiced by this order.
