JUSTICE SANJAY PRIYA ORAL ORDER 26-10-2018 Heard learned counsel for the petitioner, learned APP for the State as well as learned counsel for the informant. The petitioner seeks bail in Samastipur Muffasil P. S. Case No 117 of 2018 instituted for the offence under Section(s)147,148, 149, 448, 379, 387, 427, 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that in the written report there is no any specific allegation of overt act against this petitioner.

In the written report, it is alleged that this petitioner along with other accused persons entered into the house of the informant and made demand of Rangdari.

It is mentioned in para 3 of the bail petition that petitioner has no criminal antecedent.

Petitioner is in custody since 24.6.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-V Samastipur, in connection with Samastipur Muffasil P. S. Case No 117 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner.
