The petitioner seeks bail in anticipation of his arrest in connection with Patepur P. S. Case No. 55 of 2020 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

Regard being had to the fact that the petitioner was earlier made accused in a case of similar nature, I am not inclined to grant anticipatory bail to the petitioner notwithstanding the fact that he is only said to be the owner of the vehicle from where there is a

Patna High Court CR. MISC. No.39655 of 2020(2) dt.07-06-2021 2/2 recovery of 132.12 litres of liquor.

The prayer for anticipatory bail is rejected. However, if the petitioner surrenders before the court below and seeks bail, that shall be considered on its own merits, without being prejudiced by the fact that the present petition on his behalf has not been entertained by this Court.
