====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-09-2024 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 406, 420, 387, 379, 504 and 506/34 of the Indian Penal Code.

3. As per F.I.R., the informant was running a medical shop in the building of this petitioner, in which there are several shops, for the last 21 years on rent for Rs. 4,000/- per month and on 27.12.2023, he suddenly fell ill and became unable to move, so his shop was closed. In the meantime, the informant got an information that petitioner and his son have unlocked his shop, taken away medicine, computer etc. and locked the shop by two new locks and when he enquired about the same, the petitioner and his son became angry and started abusing him and also

Patna High Court CR. MISC. No.45128 of 2024(2) dt.13-09-2024 2/3 demanded Rs. 5,00,000/-, as Rangdari and threatened him that they would hand over the said shop to another person by a fresh agreement.

Learned counsel for the petitioner submits that as a matter of fact, this petitioner owns a building, in which, there are several shops given on rent and this is the only source of his family income. Out of which, one of the shops was given to the informant on a monthly rental of Rs. 4,000/- per month for a period of 5 years. He further submits that besides other dues, the informant did not even pay the electricity bills regularly and when the petitioner sent a registered notice in this regard through his advocate to the informant on 22.02.2023, informant refused to receive said notice and lodged this false and concocted case. He next submits that no such demand of Rs. 5,00,000/-, as Rangdari, was made by petitioner and his son. Basically, the dispute arises out of landlord and tenant relation. 5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his

Hat P.S. Case No. 54 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
