ANJANA MISHRA ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is in custody since 31.03.2017 in connection with a case registered for the offences punishable under Sections 457/380 of the Indian Penal Code. Learned counsel for the petitioner submits that in the FIR, petitioner's name has not been indicated, but his name has surfaced subsequently in the confessional statement made before the police by co-accused which has no evidentiary value. Learned counsel for the petitioner further submits that though he has been taken into custody, no recovery has been made from his possession and he has not yet been put on T.I. Parade. In view of the facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.46404 of 2017 (2) dt.21-09-2017 bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Motihari Town P.S. Case No. 541 of 2016.
