The petitioner seeks bail in connection with Amdabad P.S. Case No. 57/2016, registered for the offence punishable under Section 376(D) of the Indian Penal Code.
Prayer for bail of the petitioner was earlier rejected, vide order at Annexure-1, with a direction to the trial court to expedite the trial.
Submission of learned counsel for the petitioner is that even expiry of ten months uptill now charge has not been framed and not a single witness has been examined at this stage. Heard learned A.P.P. also.
Perused the report submitted by the learned Sessions
Patna High Court Cr.Misc. No.38707 of 2017 (3) dt.11-10-2017 2/2 Judge, Katihar, from which it appears that charge has already been framed.
In such view of the matter, learned court below is directed to expedite the trial and try to conclude the same within a period of seven months. At the same time, S.P., Katihar is directed to ensure the attendance of witnesses as well as directed to send monthly report in first week of each month.
