The petitioner seeks bail in anticipation of his arrest in connection with Sour Bazar P.S. Case No. 176 of 2019, instituted for the offences under Sections 147, 148, 149, 153(A), 153(B), 295(A), 341, 323, 353, 327, 379, 427, 435, 504 and 506 of the Indian Penal Code and
Patna High Court CR. MISC. No.39659 of 2020(2) dt.08-06-2021 2/3 Section 3⁄4 of the Public Property Damage Act, 1984. With respect to uploading of an objectionable photograph on the social media, a case was lodged which was protested by some of the miscreants. The F.I.R. appears to have been lodged against 26 accused persons and 250 unknown persons. The accusation against the miscreants including the petitioner is that they blockaded the road and disturbed the functioning of the police. The learned counsel for the petitioner has submitted that one of the accused persons of this case, viz., Nitish Kumar has been granted anticipatory bail by a Bench of this Court vide order dated 24th of January, 2020 passed in Cr. Misc. No. 85613 of 2019.
Considering the facts afore-stated and taking into account that no positive role has been assigned to the petitioner, he, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of
Patna High Court CR. MISC. No.39659 of 2020(2) dt.08-06-2021 3/3 learned Chief Judicial Magistrate, Saharsa in connection with Sour Bazar P.S. Case No. 176 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
