====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-12-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in registered for the offence punishable under Section 25(1-b)a, 26, 35 of Arms Act. As per FIR, one rifle was recovered from the house of the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is next submitted that one co-accused, Anil Yadav, has already been granted anticipatory bail vide order dated 24.05.2022 passed in Cr. Misc. No. 53946 of 2021. Petitioner has got clean antecedent.

Learned counsel for the State opposes the prayer for bail application submitting that recovery of the rifle has been

Patna High Court CR. MISC. No.42877 of 2022(2) dt.01-12-2022 2/2 made from the house of the petitioner.

Considering the fact that rifle has been recovered from the house of the petitioner, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
