JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-09-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Nautan (Jagdishpur) Police Station Case No. 48 of 2016, disclosing offences under Sections 467/468/ 471/420/307/120B/414/272/273 of the Indian Penal Code and Section 47 (a) of the Excise Act.

Considering the fact that the petitioner has criminal antecedent and is accused in as many as 12 cases, I am not inclined to grant him privilege of anticipatory bail. This application stands rejected on this very ground alone.

It is indicated that I have not gone into the

Patna High Court Cr.Misc. No.37138 of 2016 (2) dt.19-09-2016 2/2 merits of the allegation made in the First Information Report against the petitioners.

The petitioner, Nagendra Yadav, is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
