2 The petitioner has preferred this application for grant of regular bail in connection with Pusa PS Case No 79 of 2022 dated 11.08.2022 registered for the offence punishable under Sections 413, 414/34 of the IPC.

3 As per the prosecution case, the petitioner and the co-accused person stole a pick up van for the purpose of doing illegal liquor business.

4 Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has six antecedents, as stated in paragraph 3 of the bail petition. It is further submitted that the name of the

Patna High Court CR. MISC. No.43078 of 2023(2) dt.20-07-2023 2/2 petitioner has sprung up in the confessional statement of the coaccused Om Prakash Mishra. The petitioner is in custody in this case since 06.09.2022.

5 Learned APP has vehemently opposed the bail petition of the petitioner.

6 Considering the aforesaid facts and circumstances of the case, the period of custody as well as the nature of allegation against the petitioner, the petitioner above named is directed to be released on bail on his furnishing bonds of Rs 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 01st Class, Samastipur in Pusa PS Case No 79 of 2022 dated 11.08.2022.

7 This application stands allowed.
