2. Following are the reliefs sought for in the present application :

"a. To quash and set aside AnnexureP/1 i.e. the decision dated 10.06.2025 {circulated

Patna High Court CWJC No.9780 of 2025(4) dt.13-05-2026 2/3 under Memo No. 3678 (E) dated 12.06.2025 by the Engineer in Chief (Work Management), Road Construction Department, Government of Bihar, Patna} of the Departmental Tender Committee of the Road Construction Department, Government of Bihar, Patna under which the bid of this petitioner was rejected on non est grounds for the project covered under Notice Inviting Tender No. 01/2025-26, RCD, Road Division, Siwan dated 01.04.2025 (Annexure (P/2): 'Widening and Strengthening Work of Siwan-Ander Road from Ch. 0+000 Km. to 16+250 Km. (Total length 16.250 Km.) for the year 2024-25 (01 No. H.L. Bridge including)'.

b. To hold and declare the entire proceeding carried out after 10.06.2025 to be null and void.

c. To direct for opening of the financial bid of this petitioner.

d. To direct for payment of litigation cost to this petitioner.

e. Any other relief or relief (s) which the petitioner may be found entitled to in the facts and circumstances of the case."

3. Learned counsel for the State submits that during pendency of the present application, work order has already been issued and the work is in progress, rendering the present application infructuous.

4. Considering the aforesaid submission, the present application stands disposed of as having become infructuous.

5. If so advised, the petitioner, if aggrieved by the decision of the authority concerned, shall be at liberty to challenge the same by way of filing an appropriate application
