Petitioner seeks bail in Kotwali P.S. Case No.127 of 2018 instituted for the offence under Section(s) 324, 307, 506, 120/34 Indian Penal Code and Section 27 of Arms Act. Counsel for the petitioner submits that mere suspicion has been raised against the petitioner. In the written report, it is alleged that one unknown person came on motorcycle and caused fire arm injury to the informant. The informant has alleged that on 07.04.2018 at 5.00 PM this petitioner along with Pawan Mandal had given threat to shoot him because the jail staffs were not ready to allow entry of illegal articles inside the jail.
Learned APP has submitted that the informant in his
Patna High Court Cr.Misc. No.57388 of 2018 (3) dt.10-10-2018 2/2 further statement has reiterated the same facts. Besides suspicion, there is no allegation of any specific overt act against the petitioner. Threat was given to the informant on 07.04.2018, but no any official complaint was lodged anywhere by the informant against the petitioner. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger, in connection with Kotwali P.S. Case No.127 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
