The petitioner is languishing in custody in a case registered for the offences punishable under Sections 147, 148, 149, 323, 504, 307, 325 of the Indian Penal Code.

The prosecution case as per F.I.R is that all the F.I.R named accused persons including the petitioner assaulted the informant, his brother and uncle by lathi, danda, iron rod. It is alleged against the petitioner that he assaulted with iron rod to the informant on his head as a result of which, he sustained head injuries.

Patna High Court CR. MISC. No.51502 of 2023(2) dt.05-09-2023 2/2 It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. For the alleged occurrence of 13.10.2020, the F.I.R was registered on 15.10.2020. The injuries have been found to be simple in nature. The petitioner is languishing in custody since 03.01.2023.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st, Barh in connection with Salimpur P.S. Case No. 283 of 2020.
