In the light of statement made in the supplementary affidavit, counsel for the petitioner is permitted to make necessary correction in paragraph-3 of the main application in course of the day.

Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Section 414 of the Indian Penal Code and 25(1-b)a, 25(1-aa), 26/35 of the Arms Act.

Allegedly, two loaded pistols along with 9 live cartridges are said to have been recovered from possession of the

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 16-10-2018. Charge sheet has already been submitted. Two loaded pistols along with 9 live cartridges are said to have been recovered from possession of the petitioner. There is no compliance of Section 100 of Cr.P.C. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with S. Kamal P.S. Case No. 326 of 2018.
