JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 14-09-2015 The petitioner has a work shop for manufacture of iron grill etc. in Kankarbagh, Patna. He had a commercial connection for his premises. On inspection, the official of the Power Holding Company found the seal of the meter broken. They have alleged theft and have also instituted a case bearing Patrakar Nagar P.S. Case No.110 of 2013 under section 135 of the Electricity Act.

The petitioner disputes that his meter was tempered. He makes a request for testing of the meter by the appropriate agency. Having considered the facts and circumstances of the case, if the petitioner files a petition before the Special Court, in seisin of the case, he would pass an appropriate order expeditiously directing the meter to be tested by an appropriate authority within a time frame not exceeding two months from the date of order of learned Special Court. With the aforesaid directions and observations, this writ application stands disposed of.
