====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 47, 47 (A), 48, 53, 55 of Excise Act. It is contended that, as per allegation, huge quantity of illegal liquor were recovered from the vehicle. It is contended that the present case was lodged under the Old Excise Act. The petitioner is said to be the Manager of the Wine Shop and the goods were transported from one shop to another. It is contended that the said Wine Shop was running on the basis of valid licence. The petitioner and another were granted anticipatory bail vide order dated 9.03.2016 passed in Cr. Misc. No.58564/2015 (Annexure-1) by a co-ordinate Bench of this
Patna High Court Cr.Misc. No.38239 of 2017(2) dt.19-08-2017 2/2 Court. Both were directed to deposit Rs.25,000/-each in the court below but the petitioner did not deposit or surrender before the court below. Thereafter, he was arrested on 7.07.2017.
Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M, 5th, Motihari, East Champaran in connection with Pakridayal P.S. Case No.112/2015 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds. Further condition that now in place of Rs.25,000/-, the petitioner would deposit Rs.35,000/- in the court below which will be subject to the final disposal of the case as he has not followed the direction of this Court.
