2. Despite repeated calls, none appears on behalf of the appellant, whereas Mr. Abhimanyu Sharma, learned Additional Public Prosecutor for the State is present.

3. Perusal of record shows that vide letter dated 28.04.2026 of Assistant Registrar, Criminal Appeal Section of this Court, a living status report of accused appellant was called for. In response thereto, Superintendent of Police, Khagaria submitted a report dated 16.05.2026 based on the information

Patna High Court CR. APP (DB) No. 142 of 2008(4) dt.22-07-2026 2/2 furnished by S.H.O., Chautham Police Station, Khagaria apprising this Court that the sole appellant namely, Kaushal Singh has died on 09.04.2025 during pendency of this Criminal Appeal. The Death Certificate dated 02.05.2025 issued by Registrar (Birth & Death) Chautham Gramin, Khagaria is also enclosed along with the said report.

4. In view of the above, the instant Criminal Appeal filed by appellant-Kaushal Singh stands abated.
