JUSTICE BIRENDRA KUMAR ORAL ORDER 31-10-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act. The assailant of the father of the informant is coaccused-Nitish Kumar. The petitioner had visited few minutes prior to the occurrence in the office of the deceased and thereafter the named person including Nitish Kumar entered thereat.
Submission is that petitioner has been falsely implicated in this case, as the petitioner had lodged
Patna High Court Cr.Misc. No.56556 of 2018 (3) dt.31-10-2018 2/2 Kauakol P.S. Case No.104 of 2014 against the present informant and others for offences under Sections 302,201/34 of the Indian Penal Code.
Considering the fact that there is no direct material against the petitioner, who is a female, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Chandradeep P.S.Case No.43 of 2017, corresponding to G.R.No.899 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
