The petitioner has filed the instant application for grant of regular bail in connection with Majhauliya P.S. Case No. 364 of 2022 registered under sections 467, 468, 471, 420 and 120(B) of the Indian Penal Code.

Allegation against the petitioner is that he got appointment as Panchayat teacher in Middle School, Harpur on the basis of forged document.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is further submitted that the petitioner got appointment as Panchayat teacher in the year 2006 on the basis of marks obtained in Madhayama

Patna High Court CR. MISC. No.42880 of 2022(5) dt.14-02-2023 2/2 Examination. The Appointment Committee got verified the entire certificates of the petitioner including the marksheet of Madhayama and as per report the entire certificates of the petitioner is found genuine. A statement has been made in para3 of this petition that the petitioner has got no criminal antecedent. He is languishing in judicial custody since 18.05.2022.

The application for bail is vehemently opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Majhauliya P.S. Case No. 364 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran.
