JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 325, 379, 354/34 of the Indian Penal Code. It is alleged that petitioner assaulted with axe on the head of the informant when co-accused Tanu Singh assaulted with iron rod to the father of the informant Mahendra Singh causing fracture injury. When the wife of the informant came to rescue then this petitioner pushed her down and coaccused Pramila Devi assaulted her with lathi. It is further alleged that co-accused Tanu Singh snatched silver chain of the wife of the informant.

It is submitted by learned counsel for the petitioner that though injury has been found to be grievous in nature, but there is no accusation of repeating the blow. There is counter version of the occurrence also.

Patna High Court Cr.Misc. No.38326 of 2015 (3) dt.09-10-2015 2/2 A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Khaira P.S. Case No. 131 of 2015, pending in the Court of learned Judicial Magistrate, 1st Class, Jamui. With the observations above, the application stands disposed off.
