20-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner, in the present case, is seeking regular bail in connection with Town P.S. Case No. 262 of 2017 registered for the offence punishable under Sections 304(B),. 201, 120(B)/34 of the Indian Penal Code.

Petitioner is the younger brother-in-law of the deceased (Dewar). The allegation in the F.I.R. is that the husband, his brother and mother were demanding a motorcycle and a golden chain as reported by the deceased to her father over mobile.

Learned counsel for the petitioner submits that from the F.I.R. itself it will appear that according to

Patna High Court Cr.Misc. No.44639 of 2017 (2) dt.20-09-2017 the informant the deceased was living with her husband separately. Husband of the deceased is already in custody and in similarly situated circumstance mother-in-law has already been granted regular bail by this Court vide order dated 13.07.2017 passed in Cr. Misc. No. 31794/2017. Learned Additional Public Prosecutor for the State opposes the prayer for bail of the petitioner. Considering the facts and circumstances that the petitioner is Dewar, and as per F.I.R., the deceased was living with her husband separately, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Town P.S. Case No. 262 of 2017, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
