JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-07-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 24.12.2020, within four weeks of starting of Court proceeding in physical mode in normal course. Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in connection with Cheriabariarpur P.S. Case no. 132 of 2020, registered under Section 25(1-B)a, 26(i), 35 of the Arms Act. The accusation is that on receiving secret information about gathering of four persons on boarding on four motorcycles in village-Bichkhana, the informant along with other Police personnel reached there. On seeing the Police party, all started fleeing, but, on chase, one person was apprehended, who disclosed his name Keshav Singh, while

Patna High Court CR. MISC. No.39480 of 2020(2) dt.16-07-2021 2/2 other succeeded to flee away. On search, Keshav Singh was found in possession of one country made pistol and one live cartridge. On query, he disclosed the name of his three associates, who succeeded to flee away, as Chintu Singh @ Raman Kumar, Amit Kumar and Paras Sahni (Petitioner) Learned counsel for the petitioner submits that petitioner was not apprehended on the spot, rather, his name has been disclosed by co-accused Keshav Singh, who is said to be apprehended by the Police with one country made pistol along with one live cartridge. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Begusarai in connection with Cheriabariarpur P.S. Case no. 132 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
