17-04-2021 Heard learned counsel for the parties through virtual mode.
The petitioner seeks bail in Bhagan Bazar P.S. Case No. 308 of 2020, registered for the offence under Sections 414, 420, 467, 468, 471 of the Indian Penal Code.
As per the prosecution case, during checking of vehicles, one co-accused Raja Sah with a stolen motorcycle was apprehended and at his instance, several stolen motorcycles were recovered from the houses of other accused persons. It is alleged that from the house of petitioner, three stolen motorcycles were recovered.
It is submitted on behalf of petitioner that no stolen motorcycle has been recovered from the possession of the petitioner and the alleged recovery has been made by the side of the house of the petitioner and not from the house of the
Patna High Court CR. MISC. No.8095 of 2021(2) dt.17-04-2021 2/2 petitioner. Petitioner has got clean antecedent and he is in custody since 15.07.2020. Chargesheet has already been submitted.
Considering the period of custody and clean antecedent of the petitioner, the bail application of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Saran at Chapra in connection with Bhagwan Bazar P.S. Case No. 308 of 2020, on the following conditions: "(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the court below and shall remain physically present, as directed by the court below, and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the court below.
(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
