The petitioners seek bail in Jaipur P. S. Case No. 08 of 2019 instituted for the offence under Section 414 of the I.P.C. and Sections 25(1-b)A, 26, 35 of the Arms Act. It is alleged that one county made pistol has been recovered from possession of petitioner no.1. It is further alleged that one mobile phone has been recovered from possession of petitioner no.2 Petitioners are in custody since 20.2.2019 having no criminal antecedent.

Keeping in view the period of custody already spent

Patna High Court CR. MISC. No.40236 of 2019(2) dt.05-07-2019 2/2 by petitioners, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the ACJM-1 Banka in connection with Jaipur P. S. Case No. 08 of 2019 subject to the following conditions:- (i) Both the bailors shall be the close relative of the petitioners.

(ii) The petitioners shall be present on each and every date fixed by the Court and absence on two consecutive dates without valid reason will result in cancellation of bail bond of the petitioners.

(iii) If petitioners tamper with the evidence in the case, prosecution will be at liberty to move for cancellation of bail bond of the petitioners.
