The petitioner prays for grant of anticipatory bail in Buxar (T) P.S. Case No. 353 of 2013 registered on 04.09.2013 under section 365 IPC.
The son of the informant was kidnapped while he had gone out of the house whereafter a ransom call was received inasmuch as ransom amount was placed at the place indicated by the caller. Even thereafter, his son did not return. The informant suspected the hands of the petitioner, who is the wife of the son in the alleged crime as the victim was not having cordial relation with the wife who was having illicit relationship with another person. The trial of some of the accuseds was taken up in which
Patna High Court Cr.Misc. No.54530 of 2016 (2) dt.23-12-2016 2/2 the witnesses were examined and deposed which provided incriminating material to the learned trial court whereafter notice under section 319 Cr. P.C. was issued.
Considering the facts and circumstances of the case, in my view, the petitioner should respond to the notice and appear before the trial court and may apply for grant of bail which shall be considered and disposed of on its own merit by the learned trial court in accordance with law.
The present application is disposed of.
