====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 13-12-2016 Heard the learned counsel for the petitioners and the State.
This is a petition for grant of anticipatory bail for offence under Sections 448, 307, 511, 323 and 34 of the Indian Penal Code.
A matrimonial dispute is going on between the informant and her husband vide the Complaint Case No.803c of 2015, a case under Sections 498A and 494 of the Indian Penal Code. To pressurize the withdrawal of the aforesaid case the other in-laws, including the petitioners, allegedly attempted to commit the murder of the informant by pouring kerosene oil and attempted to burn the informant.
Submission of the petitioners is that no injury was caused to the informant. False allegation is there just to pressurize after ten years of marriage. The petitioners have nothing to do with the matrimonial life of the informant and with her husband. The learned counsel for the informant opposed the prayer for bail.
Considering the aforesaid fact, the petitioners, above
Patna High Court Cr.Misc. No.48947 of 2016 (3) dt.13-12-2016 named, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Mahila P.S. Case No. 110 of 2016 to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
