====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-07-2024 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in case registered for the offences punishable under Sections 25(1-A), 25(1-B)(i), 25(1-AA), 26, 35 of Arms Act.

3. On secret information, a raid was conducted and used arms and ammunition were recovered from house of this petitioner.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner and he has been made accused only on confessional statement of co-accused. It is next submitted that petitioner is simply owner of the house in question and it is on rent.

5. Learned A.P.P. for the State opposed the bail

Patna High Court CR. MISC. No.45120 of 2024(2) dt.29-07-2024 2/2 application and submitted that petitioner is owner of the house from which huge quantity of arms and ammunition have been recovered and he has got 8 criminal antecedents.

6. Considering the aforesaid facts and circumstances of the case, prayer for anticipatory bail of the petitioner is refused.
