Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in K. Hat (Madhubani) P.S. Case No. 194 of 2019, instituted for the offence under Section(s) 25(1-b)a and 26 of the Arms Act.

It is alleged in the written report that one country made pistol along with one cartridge and one country made loaded pistol made in U.S. have been recovered from a ditch under Machan situated in front of house of the petitioner. Counsel for the petitioner submits that petitioner is

Patna High Court CR. MISC. No.40266 of 2019(2) dt.05-07-2019 2/2 in custody since 20.3.2019 having clean antecedent. Petitioner has been made accused merely on suspicion.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with K. Hat (Madhubani) P.S. Case No. 194 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
