The petitioners apprehend their arrest in Dhoraiya P.S. Case No.35 of 2019 registered under Sections 363, 366(A), 341, 323, 504/34 of the Indian Penal Code.
The mother of the victim disclosed that her daughter went to learn computer but she did not return. The informant came to know that Badal Mandal, son of the petitioners kidnapped her daughter for the purpose of marriage. The learned counsel for the petitioners submits that the petitioners are parents of Badal Mandal. The petitioners did not pay any role in kidnapping of the victim but the police is running after the petitioners.
Taking into consideration the facts aforesaid and
Patna High Court CR. MISC. No.41015 of 2019(2) dt.03-07-2019 2/2 nature of allegation made against the petitioners and the fact that the petitioners are parents of Badal Mandal who is alleged to have kidnapped the daughter of the informant, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Dhoraiya P.S. Case No.35 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
