Petitioners are languishing in judicial custody since 31.01.2017 in connection with Mahendia P.S. Case No. 09/2017 for offences punishable under Sections 379, 411 of the Indian Penal Code and Section 11 of the Animals Cruelty Act. The prosecution case, as lodged by the Dafadar, is that search was conducted and two ox and buffaloes were found with cut ears. Accordingly, a seizure-list was prepared. It has been submitted by the learned counsel for the petitioners that they are innocent, bear no criminal history and have been falsely implicated in the aforesaid case. He submits that the petitioners were not dealing with stolen animals and belonged
Patna High Court Cr.Misc. No.48249 of 2017 (3) dt.21-12-2017 2/2 to another village and have no connection with the accused persons. He submits that some of the accused persons have been granted the privilege of bail and pre-arrest bail by this Court, charge-sheet has already been submitted and there is no allegation of tampering of the prosecution witnesses by the petitioners. However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioners, above named, be enlarged on bail on furnishing bail bonds of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad, in connection with Mehandiya P.S. Case No. 09 of 2017.
