In the instant petition, petitioner has prayed for following reliefs:- "i) To issue an appropriate writ(s), order(s), direction(s) in the nature of writ of Certiorari for quashing the order issued vide DOC No. 595 dated 06.07.2022 under the signature of the respondent Senior Project Engineer (as contained in Annexure-16) whereby the contract awarded to the petitioner for "Construction of H.L. R.C.C. bridge (10x18.00 over river Dardha including approach road between Paibigha Bazar to
2/5 Balabigha village in the District of Gaya" vide Agreement No.- SBD-03 of 2021-22 has been rescinded and the measurement of the work don will be made on 09.07.2022.
ii) To issue an appropriate writ(s), order(s), direction(s) in the nature of writ of Mandamus directing the respondents to pay the admitted amount of dues for the work done by the petitioner and also to refund the amount of other deductions which has been made by the department along with reasonable interest thereon as there was no fault on the part of the petitioner in not completing the work within the stipulated period as provided in the contract. iii) To any other relief or reliefs for which the petitioner is found to be entitled in the facts and circumstances of the case."
3. Petitioner has assailed the order dated 06.07.2022 and sought various directions. The communication dated 06.07.2022 reads as under:- "

4/5 अनपुसयार आपकबी मंरया कयार्य करनप्रे कबी नहहीं ह।आपसप्रे कयार्य करयानप्रे हप्रेतपु अधियोहस्तयाक्षरबी एविमं विरबीर पदयाजधिकयाजररत्रों कप्रे दयारया हर समंभिवि प्ररयास जकरया गरया ह, परन्तपु ऐन-कप्रेन-प्रकप्रेन आप कयार्य कयो उलझयाकर रखप्रे हपुरप्रे ह। उपरयोक्त विजणत तथ्रत्रों कप्रे आलयोक महें SBD के कंबडका-3 (When Contract can be determined / Rescined) केउप कंबडका- iii) If the contractor has, without reasonable cause, suspended the progress of the work or has failed to proceed with the work with due diligence so that in the opinion of the Engineer- in-Charge (which shall be final and binding) he will be unable to secure completion of the work by the date of completion and continues to do so after a notice in writing of seven |days from the Engineer-in-Charge.
iv) If the contractor fails to complete the work within the stipulated date or items of work with individual date of completion, if any stipulated, on or before such date(s) of completion and does not complete them within the period specified in a notice given in writing in that behalf by the Engineer-in-Charge, v) If the contractor persistently neglects to carry out his obligations under the contract and/or commits default in complying with any of the terms and conditions of the contract and does not remedy it or take effective steps to remedy it within 7 days after a notice in writing is given to him in that behalf by the Engineer-in-Charge केआलोकरेआपकोRescined बकयाजाताहै। अततः आपकयो सपूजचत जकरया जियातया ह जक अब तक करयारप्रे गरप्रे कयाररमं कया अजन्तम मयापबी हप्रेतपु जदनत्रांक 0907-2022 (जदन रजनवियार) जनधिर्याजरत जकरया जियातया ह। जनधिर्याजरत जतजथ कयो आप स्विरमं रया आपकप्रे दयारया अजधिककत प्रजतजनजधि प्रयाततः 11:00 AM बजिप्रे जबनया चपूक स्थल पर अजन्तम मयापबी हप्रेतपु उपजस्थत हयोनया सपुजनजश्चित करहेंगप्रे। जनधिर्याजरत जतजथ कयो स्थल पर आप रया आपकप्रे प्रजतजनजधि कप्रे अनपुपयाजस्थजत महें जनगम कप्रे पजररयोजिनया अजभिरमंतया, कनबीर अजभिरमंतया दयारया मयापबी कर लबी जियारप्रेगबी, जियो आपकयो मयान्र हयोगया।

Reading of the aforesaid document, there is no infirmity and there is no provision for providing any relaxation to the petitioner insofar as subject-matter of work is concerned.
4. Today, learned counsel for the petitioner sought relaxation under the communication of Government of India, Ministry of Road Transport and Highways (Highways Division). The petitioner cannot take shelter under the aforesaid communication dated 11.04.2022 for the reasons that it is in respect of National Highways and other Centrally Sponsored Schemes. The present work is relating to State of Bihar- State Schemes. Therefore, Circular dated 11.04.2022 is not applicable to the case in hand.
