The petitioner apprehends his arrest in connection with Manpur P.S. Case No.39 of 2015 registered under Sections 341, 323, 324, 325, 307 and 504/34 of the Indian Penal Code. The allegation against the petitioner is that he assaulted the wife of the informant with 'Khanti', causing injury in her arm of the right side hand'.
Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner has falsely been implicated in this case with the allegation of assaulting the wife of the informant
Patna High Court Cr.Misc. No.50258 of 2015 (3) dt.10-12-2015 2/2 with 'Khanit, causing injury in her arm of the right side hand. It is further submitted that it would appear from the impugned order, whereby the prayer of the petitioner for grant of anticipatory bail was rejected, the injuries were found on the head of the injured, which is vital part.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender within four weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bihar Sharif, in connection with Manpur P.S. Case No.39 of 2015, subject to the conditions laid down under Section 438(2) Cr. P.C.
