JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 04-11-2015 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner seeks pre-arrest bail in connection with Muffasil P. S. Case No. 435 of 2014 registered under Sections 461 and 379 of the Indian Penal Code.
It is contended that save and except confessional statement of co-accused, there is no other material to connect the petitioner with the offence alleged.
Be that as it may, regard being had to the fact that the case was registered against unknown and the name of the petitioner transpired in course of investigation on the basis of disclosure made by a co-accused, I am not inclined to grant him
Patna High Court Cr.Misc. No.49564 of 2015 (2) dt.04-11-2015 2/2 anticipatory bail. Accordingly, the application for anticipatory bail is rejected.
In case, the petitioner surrenders and seeks bail, the same shall be considered on its own merit without being prejudiced in any manner by this order.
