Petitioner are apprehending their arrest in a case registered for offences punishable under Sections 341, 323, 379 and 504/34 of the Indian Penal Code.

Heard learned A.P.P. also.

It has been submitted on behalf of the petitioners that there is case and counter case between the parties. The petitioner is the own brother of the informant and others are nephew and grand son of the informant and the allegation that they took away Rs. 1,00,000/- is a concocted story. Learned counsel for the petitioners

Patna High Court Cr.Misc. No.50981 of 2016 (2) dt.19-12-2016 2/2 further submitted that save and except general and omnibus allegation, nothing has come on F.I.R.

Considering the submission, as above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within a period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Falka (Pothia )P.S. Case No. 209 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
