JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2018 Petitioner prays for bail in connection with Narhat P.S.Case No. 166 of 2012 registered for the offences punishable under Sections 341, 323, 324, 307, 302 and 504/34 of the Indian Penal Code.

Allegation against the petitioner is of assault by Garasa to the father of informant, due to which he received injuries and later on succumbed to the injuries. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and whole family members have been made accused in this case and petitioner is in custody since 3.8.2018.

Heard learned APP and learned counsel for the informant. They have opposed the prayer for bail stating that

No.57991 of 2018(3) dt.05-11-2018 2/2 there is specific allegation against the petitioner of assault and moreover case is of the year 2012 and charge sheet has been submitted in the year 2014 showing the petitioner absconder. Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner.

Hence, this application is dismissed.
