The petitioner apprehends his arrest in Kako P.S. Case No. 146 of 2014 registered for the offences punishable under Sections 366(A) and 34 of the Indian Penal Code. The informant alleged that his minor daughter went to Sun temple to offer milk at about 8:00 in the morning on 27.07.2014, but she did not return. The informant was inside the jail therefore his wife did not inform anybody. The informant came out from jail on 07.08.2014 and enquired about his daughter from his relatives. The informant suspected that Aftab Alam, Samjira Khatoon, Rajiv Kumar, the petitioner, Rajesh Paswan and Bunty Kumar enticed away his daughter.
Learned counsel for the petitioner submits that save and
Patna High Court Cr.Misc. No.41340 of 2016 (4) dt.23-03-2017 2/2 except suspicion there is no material against the petitioner. Coaccused Bunty Kumar has already been granted anticipatory bail in Cr. Misc. No. 57003 of 2015, Aftab Alam @ Md. Aftab Alam @ Md. Aftab has already been granted bail vide order dated 20.09.2016 passed in Cr. Misc. No. 33632 of 2016 by this Court. Samjeera Khatoon has been enlarged on regular bail vide order dated 13.10.2015 passed in Cr. Misc. No. 27064 of 2015 and the case of the petitioner stands on same footing. Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Jehanabad in Kako P.S. Case No. 146 of 2014, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
