JUSTICE SANJAY PRIYA ORAL ORDER 31-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Triveniganj P.S. Case No. 158 of 2017 instituted for the offence under Section 379 of the Indian Penal Code.

It has been submitted that First Information Report is against unknown. The name of this petitioner has been disclosed by co-accused Sunil Kumar Yadav, in his confessional statement. There is recovery of one Mobile phone from possession of this petitioner but no Test Identification Parade of the aforesaid article was made. It has further been submitted that co-accused Kusheshwar Yadav has been granted bail by a coordinate Bench of this Court vide order dated 6.7.2017 passed in Cr. Misc. 30904 of 2017.

Patna High Court Cr.Misc. No.32463 of 2017 (3) dt.31-07-2017 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Supaul, in connection with Triveniganj P.S.
