2. The petitioners apprehend their arrest in a case registered for the offence under Sections 103(1), 61(2), 3(5) of the Bhartiya Nyaya Sanhita.

3. As per the prosecution case, one Sunil Mandal was married to Manorama Devi and from the wedlock, he had a daughter namely Rubi Devi, who was married to Brajesh Mandal, whereas mother of Sunil Mandal is Sudami Devi. It is alleged that Sunil Mandal was married with mother of informant (deceased) about more than 20 years back and out of the wedlock, the informant and another child (8 years) were born

Patna High Court CR. MISC. No.43683 of 2025(4) dt.01-12-2025 2/3 and informant, who is daughter of the deceased, alleged that his mother was killed by co-accused Rubi Devi and her husband Brajesh Mandal, in connivance with these petitioners only with a view to grab her share in the property.

4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in this case only on suspicion. As per F.I.R. itself, informant is not eye-witness to the occurrence. Petitioner no. 1 is first wife of petitioner no. 2 and petitioner no. 2 is husband of the deceased, who was his second wife. During investigation, it has come that at the time of alleged occurrence, these petitioner were in Punjab. Similarly situated co-accused persons have already been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 15.05.2025 passed in Cr.Misc. No. 18987 of 2025 (Annexure P/2). Petitioners claim clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the
