====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 28-07-2025 Heard Mr. Madhurendra Kumar, learned counsel for the Petitioner and Mr. Pronoti Singh, learned APP for the State.
2. Petitioner seeks regular bail in connection with Raghunathpur P.S. Case No. 125 of 2024 dated 17.10.2024 registered for the offences punishable under Sections 306 and 318(4) of the BNS.
3. The main submissions advanced by the petitioner's counsel are that the instant matter relates to theft committed in the house of the informant with regard to her ornaments and cash amount, petitioner has been made accused mainly on suspicion as he was serving as driver of the informant at the time of the alleged occurrence. Some ornaments have been recovered from the shop of co-accused, Gyan Prakash, who was granted bail by the trial court. Petitioner has been languishing in jail since 19.10.2024 and
Patna High Court CR. MISC. No.44300 of 2025(2) dt.28-07-2025 2/2 against him investigation has been completed.
4. Learned APP appearing for the State has opposed the prayer for bail of the petitioner.
5. Heard both the sides and perused the FIR as well as trial court's order. Though, as per prosecution, some of the stolen articles have been recovered on the disclosure statement made by the petitioner before the police, however, considering his custody period and completion of investigation against him, this court is inclined to take a lenient approach to the prayer for bail of the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount to the satisfaction of the concerned Court in connection with Raghunathpur P.S. Case No. 125 of 2024.
