JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-07-2021 As prayed for, through video conferencing, let the learned counsel for the petitioner remove the defect(s), as pointed out by the office vide it's note, dated 24.12.2020, within four weeks of starting of the Court proceeding in physical mode properly.

Heard the parties through video conferencing. The petitioner seeks pre-arrest bail in connection with Wazirganj P.S. Case No. 334 of 2020, registered under Sections 341, 323, 504, 354 and 379/34 of the Indian Penal Code. The accusation is that in the evening of 16.07.2020, the informant, Shiv Ram Singh, was going to his field, at that time, six persons, named in the first information report, including the petitioner (Arvind Kumar @ Arvind Kumar Singh) came and caused assault at the head of the informant through iron rod. At that time, mother of the informant reached,

Patna High Court CR. MISC. No.39487 of 2020(2) dt.16-07-2021 2/2 then, she was also abused and misbehaved and her ear-rings was snatched. At that time, they all had threatened to withdraw the case.

Submission is that the petitioner and other accused are gotia of the informant and due to petty dispute the informant has lodged the present case with false allegation. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of arrest/surrender, within a period of four weeks from today, in connection with Wazirganj P.S. Case No. 334 of 2020 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
