2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in a case instituted for the offence punishable under Sections 109, 352, 351(2), r/w 3(5) of Bharatiya Nyay Sanhita and Section 27 of Arms Act.
3. The prosecution case, in brief, is that while the informant was searching for his missing daughter and was passing through the house of co-accused Rajesh Patel, the said co-accused along with the petitioner allegedly abused and chased him. It is further alleged that

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case due to village politics. It is further submitted that nothing incriminating has been recovered from the conscious possession of the petitioner. Moreover, it is a case of no injury. There is no specific allegation against the petitioner; rather, the allegations levelled are general and omnibus in nature. It is also stated in paragraph 3 of the petition that the petitioner has no criminal antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer of bail.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from
Patna High Court CR. MISC. No.41292 of 2025(2) dt.15-07-2025 3/3 receipt/production of this order and in the event of his arrest or surrender in connection with Bajpatti P.S. Case no. 70 of 2025, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st, Pupri at Sitamarhi, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
