Petitioner is in custody in connection with Maharajganj P.S. Case No. 55 of 2017 for the offence under section 328 of the Indian Penal Code.

Considering the fact that both the petitioner and the victim administered poison. The wife during the course of treatment died but the petitioner survived.

The petitioner has no criminal antecedent. He is in custody since 20.7.2018.

Considering the aforesaid, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial

Patna High Court Cr.Misc. No.56838 of 2018(2) dt.25-01-2019 2/2 Magistrate-V , Siwan, in connection with Maharajganj P.S. Case No. 55 of 2017 subject to the condition that petitioner will extend full cooperation in the early disposal of the case. The trial court is directed to expedite the trial and conclude the same on day-to-day basis preferably within a period of nine months from today. In the event, the petitioner creates hindrance in the early disposal of the case, the trial court shall be at liberty to cancel the bail bonds of the petitioner.
