The petitioner seeks bail in a case registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 3000 litres illegal mixed toddy was recovered from a Tata Magic vehicle which was being boarded by two persons including the petitioner. However, driver of the aforesaid vehicle fled away after seeing the police party and only the petitioner was apprehended. It is contended that nothing was recovered from the conscious possession of the petitioner and the petitioner has no connection with the recovered toddy or with the seized
Patna High Court Cr.Misc. No.59354 of 2018(3) dt.06-10-2018 2/2 vehicle. Petitioner claims that he is having clean antecedent and is in custody since 18.07.2018.
Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge Excise, Patna in connection with Special Case No. 6425/2018 arising out of P.R. P.S. Case No. 74/2018.
Further, if the petitioner, after his release in this case,is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
