The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 354A and 448/34 of the IPC and Section 08 of the POCSO Act. It is a case of outrage the modesty in several times of the minor girl of the informant by this petitioner. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. Petitioner has got clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

After considering the statement of the victim girl

Patna High Court CR. MISC. No.52264 of 2021(2) dt.06-04-2022 2/2 recorded under Section 164 of the Cr.P.C. as mentioned in the impugned order dated 13.08.2021, wherein she made specific allegation against this petitioner, as such, I am not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is rejected.

However, the petitioner is directed to surrender before the court below and pray for regular bail.
